I'm not sure that enterprise level businesses would want to jeopardize violating the TOS in their mobile contracts. This won't get far.

Don't be too sure. I can tell you there is no such clause in my agreements with either US Cellular or Sprint. VZW on the otherhand is like a book, and I wouldn't be surprised if there's something buried in there somewhere.

EDIT: On second thought, I don't really see how this would be against any carrier's TOS. It's really nothing more than an app that utilizes the data connection. If that is against the TOS, so would countless other apps.

Yes, but the big difference is that using a notebook tethered to a bb uses much more data than just the bb. Full websites, vpn tunnels, flash, etc. all use more bandwidth and that's what the carriers are trying to protect against in their TOS. And yes, Sprint does have that in their TOS.

If you stay within your data usage is there really any difference? The fact that you have to pay separate for tethering is highway robbery. Data is data, IMO.

I rarely hit 150 MBs of my 500 MB allowance so if I get into a pinch and need to get internet access, why can't that use the 350 MBs I haven't used yet? Yes tethering to a netbook/laptop uses more but if your within your data allowance it should all be fine. Most people tether only when they need it. Obviously if you do it constantly you're going to rack up some huge usage.

I have tether, it works great and my carrier hasn't said anything yet probably because I stay within my limits.

As far as I can tell. VZW, Sprint and AT&T have these sort of apps against their ToS and they can cancel you if they find out. I'm pretty sure if a big company knows this is against their service provider ToS, they will think twice before getting it.

DM won't let you Tether for free. It goes through your carrier.

i wouldnt be surprised at all if VZW had something buried in the contract saying you could only use approved software to tether your BB (or any phone) to a computer for data usage.
that being said.. next time this goes on sale im getting a copy.

More than the 5 gigs you're already paying for, I seriously doubt anything would be said whether it violates TOS or not. It really doesn't matter what device you use to access the data so long as you only take what you bought. Just don't stream audio or video while tethered and you'll be fine. I use it all the time.

The big 3 in Canada (Rogers/Telus/Bell) all include tethering use at no additional charge for data plans of 1 GB or more. It just counts against your monthly data allotment.
